Federal Court Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was held in federal detention.

In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal proceedings involve conflicting claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.

The court, who was hearing his petition to deportation in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
